These General Terms and Conditions ("Agreement") set forth the use of the padmehumstudioindia.com website ("Website" or "Service") and any of its related products and services (collectively, "Services").

This Agreement is legally binding between you ("User", "you" or "your") and Padme Hum Studio (Padme Hum Studio", "we", "us" or "our").

In the event that you are entering into this agreement on behalf of an individual or any legal entity, you represent that you have the authority to enter into this agreement, in which case the terms "User", "you" or "your" shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this agreement, you must not accept this agreement and may not access and use the Website and Services.

By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.

You acknowledge that this Agreement constitutes a contract between you and Padme Hum Studio, even though it is an electronic agreement that you do not physically sign. It governs your use of the Website and Services.

A) PRIVACY POLICY

We respect your privacy and are committed to protecting it through our compliance with this privacy policy ("Policy"). This Policy describes the types of information we may collect from you or that you may provide ("Personal Information") on the padmehumstudioindia.com website ("Website" or "Service") and any of its related products and services (collectively, "Services"), and our practices for collecting, using, maintaining, protecting, and disclosing that Personal Information. Collection of personal information

You must be at least 18 years of age to use the Website and Services. You can access and use the Website and Services to browse without disclosing your identity or providing any information that could be used to identify you as a specific, identifiable individual.

If, however, you wish to use some of the features offered on the Website for e-commerce, you may be asked to provide certain Personal Information, as follows:

Account details (such as user name, unique user ID, password, etc.)

Contact information (such as email id, address, phone number, etc.)

Basic personal information (such as name, country of residence, etc.)

Any other materials you willingly submit to us (such as articles, images, feedback, etc.)

We receive and store any information you knowingly provide to us when you create an account, make a purchase, or fill out any forms on the Website. Users who are uncertain about what information is mandatory are welcome to contact us for clarification.

We do not knowingly collect any Personal Information from children under the age of 18. If you are under the age of 18, please do not submit any Personal information through the Website and Services.

We also ask that all parents and legal guardians overseeing the care of children take the necessary precautions to ensure that their children are instructed not to disclose Personal Information online without permission.

Use and processing of collected information

When handling Personal Information, we act as a Data Controller and a Data Processor. However, if we have entered into a Data Processing agreement with you, you would be the Data Controller and we would be the Data Processor. To make the Website and Services available to you or to fulfil a legal obligation, we may need to collect and use certain Personal Information. Any of the information we collect from you may be used for the following purposes:

  • Fulfil and manage orders

All sensitive payment information is transmitted via Secure Socket Layer (SSL) technology and encrypted during transfer, ensuring your data is protected at all times. We only share your payment information with these processors to the extent necessary to complete the transaction, issue refunds, or resolve payment-related concerns.

Please note: We do not store your payment details on our servers.

Please note that the Payment Processors may collect some Personal Information from you, which allows them to process your payments (e.g., your email address, address, credit card details, and bank account number) and handle all steps in the payment process through their systems, including data collection and processing.

While we take your privacy seriously, please be aware that our Payment Processors maintain their own privacy policies. These may differ from our practices. We recommend that you review their privacy policies to understand how your personal information will be handled by them.

Rest assured, we only share information required to process payments or resolve related issues, and we do so with reputable providers who follow strict security protocols.

Managing information

You can delete certain Personal Information we have about you. The Personal Information you can delete may change as the Website and Services change. When you delete Personal Information, however, we may maintain a copy of the unrevised Personal Information in our records for the duration necessary to comply with our obligations to our affiliates and partners. If you would like to delete your Personal Information or permanently delete your account, you can do so by contacting us.

Disclosure of information

Depending on the requested Services or as necessary to complete any transaction or provide any Service you have requested, we may share your information with our affiliates, contracted companies, and service providers (collectively, "Service Providers") we rely upon to assist in the operation of the Website and Services available to you and whose privacy policies are consistent with ours or who agree to abide by our policies concerning Personal Information. Suppose we undergo a business transition, such as a merger or acquisition by another company, or the sale of all or a portion of our assets. In that case, your user account and Personal Information will likely be among the assets transferred.

Retention of information

We will retain and use your Personal information for the period necessary to comply with our legal obligations, as long as your user account remains active, to enforce our agreements, resolve disputes, and unless a more extended retention period is required or permitted by law.

We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally. Once the retention period expires, Personal information shall be deleted.

These Social Media Features may collect your IP address, the page you are visiting on our Website and Services, and may set a cookie to enable these Features to function properly. Social Media Features are hosted either by their respective providers or directly on our Website and Services. Your interactions with these Social Media Features are governed by the privacy policy of the respective providers.

The Website and Services contain links to other resources that are not owned or controlled by us. Please be aware that we are not responsible for the privacy practices of such other resources or third parties. We secure information you provide on computer servers in a controlled, secure environment, protected from unauthorised access, use, or disclosure.

While we strive to protect your Personal Information, you acknowledge that (i) there are security and privacy limitations of the Internet which are beyond our control; (ii) the security, integrity, and privacy of any information and data exchanged between you and the Website and Services cannot be guaranteed; and (iii) any such information and data may be viewed or tampered with in transit by a third party, despite best efforts.

Data breach

In the event we become aware that the security of the Website and Services has been compromised or Users' Personal Information has been disclosed to unrelated third parties as a result of external activity, including, but not limited to, security attacks or fraud, we reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities.

Exchange

The Products of Padme Hum are brittle with scope for transit damage despite proper packaging. Exchange is only applicable when the product received is damaged during transit. Please provide photographic evidence within 3 days of receipt of the product. If satisfactory, we will replace and dispatch it within 30 days.

Return

The store does not have a return policy since dispatch will be made only after the customer approves the product sample.

Cancellation

Since each of our pottery products is handcrafted and often made-to-order, cancellations are generally not allowed once production has begun. However:

  • For items labelled as “ready-to-ship” (pre-made and available in limited quantity), cancellation is permitted only before the item is dispatched.
  • Once a product is shipped, the order cannot be cancelled.

Accounts and membership

Once you create an account on the Website, you are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under the account, as well as any other actions taken in connection with it. We are under no obligation to monitor and review new accounts before you sign in and start using the Services. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill.

Billing and payments

You shall pay all fees or charges to your account by the fees, charges, and billing terms in effect at the time a fee or charge is due and payable.


Product change and pricing

We reserve the right to change products and product pricing at any time. We also reserve the right to refuse any order you place with us. If we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address and/or phone number provided at the time the order was placed. 

Accuracy of information

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if no advance has been received, in case any information on the Website or Services is inaccurate at any time without prior notice. We undertake no obligation to update, amend or clarify information on the Website, including, without limitation, pricing information, except as required by law.

Links to other resources

Although the Website and Services may link to other resources (such as websites and mobile applications), we do not, directly or indirectly, imply any approval, association, sponsorship, endorsement, or affiliation with any linked resource, unless specifically stated herein. You should carefully review the legal statements and other conditions of use of any resource which you access through a link on the Website.

Prohibited uses

In addition to other terms as outlined in the Agreement, you are prohibited from using the Website and Services or Content: (a) for any unlawful purpose, (b) to infringe upon or violate our intellectual property rights or the Intellectual property rights of others; (c) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (d) to submit false or misleading information; (e) to spam, phish, pharm, pretext, spider, crawl, or scrape, or (f) to interfere with or circumvent the security features of the Website and Services, third party products and services, or the Internet. We reserve the right to terminate your use of the Website and Services if you violate any of the prohibited uses.

Intellectual property rights

"Intellectual Property Rights" means all present and future rights conferred by statute, common law or equity in or about any copyright and related rights, trademarks, designs, patents, inventions, goodwill and the right to sue for passing off, rights to inventions, rights to use, and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, rights to claim priority from, such rights and all similar or equivalent rights or forms of protection and any other results of intellectual activity which subsist or will subsist now or in the future in any part of the world. This Agreement does not transfer to you any intellectual property owned by Padme Hum Studio or third parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with Padme Hum Studio. All trademarks, service marks, graphics and logos used in connection with the Website and Services are trademarks or registered trademarks of Padme Hum Studio or its licensors. Other trademarks, service marks, graphics and logos used in connection with the Website and Services may be the trademarks of other third parties. Your use of the Website and Services grants you no right or license to reproduce or otherwise use any of Padme Hum Studio or third-party trademarks.

Disclaimer of Warranty

You agree that such Service is provided on an "as is" and "as available" basis and that your use of the Website and Services is solely at your own risk. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We make no warranty that the Services will meet your requirements, or that the Service will be uninterrupted, timely, secure, or error-free, nor do we make any warranty as to the results that may be obtained from the use of the Service or as to the accuracy or reliability of any information obtained through the Service or that defects in the Service will be corrected. We make no warranty regarding any goods or services purchased or obtained through the Service or any transactions entered into through the Service unless stated otherwise.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Padme Hum Studio, its affiliates, directors, officers, employees, agents, suppliers or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages. To the maximum extent permitted by applicable law, the aggregate liability of Padme Hum Studio and its affiliates, officers, employees, agents, suppliers and licensors relating to the services will be limited to an amount no greater than one dollar or any amounts paid in cash by you to Padme Hum Studio for the prior one month period before the first event or occurrence giving rise to such liability.

Indemnification

You agree to indemnify and hold Padme Hum Studio and its affiliates, directors, officers, employees, agents, suppliers and licensors harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys' fees, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website and Services or any willful misconduct on your part.

Severability

All rights and restrictions contained in this Agreement may be exercised. They shall apply and be binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable. 

Dispute resolution

The formation, interpretation, and performance of this Agreement, as well as any disputes arising out of it, shall be governed by the substantive and procedural laws of Delhi, India, without regard to its rules on conflicts of law or choice of law, and, to the extent applicable, the laws of India. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in Delhi, India, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement.

Assignment

You may not assign, resell, sub-license or otherwise transfer or delegate any of your rights or obligations hereunder, in whole or in part, without our prior written consent, which consent shall be at our sole discretion and without obligation; any such assignment or transfer shall be null and void. We are free to assign any of its rights or obligations hereunder, in whole or in part, to any third party as part of the sale of all or substantially all of its assets or stock or as part of a merger.

Changes and amendments

We reserve the right to modify this Agreement or its terms related to the Website and Services at any time at our discretion. When we do, we will update the date at the bottom of this page.

Your continued use of the Website and Services after the effective date of the revised Agreement will constitute your acceptance of and consent to those changes.

Acceptance of these terms

You acknowledge that you have read this Agreement and agree to all its terms and conditions. If you do not agree to abide by the terms of this Agreement, you are not authorised to access or use the Website and Services.
